BECOME AN AFFILIATE OF THE BLUE MOUNTAIN SURF ADVENTURE NETWORK
Blue Mountain Surf, Inc. (BMS) operates the BMS Adventure Network for companies offering adventure-related goods and services. The BMS Adventure Network is comprised of independent contractors, participating companies, equipment suppliers, advertisers, event sponsors, non-profits, community partners, and other affiliates. We offer the following affiliate categories:
- Independent Contractor
An Independent Contractor is an individual or entity that provides goods and services to BMS and its customers as a contractor of BMS. Independent Contractor will deliver goods and services to customers under the brands of BMS. BMS is responsible for all advertising and other administrative functions. Independent Contractor will be engaged by BMS from time to time as needed for customers. BMS sets all prices for goods and services offered to customers. BMS is responsible for collecting amounts due from customers. BMS will compensate Independent Contractor on an hourly, fixed fee, commission, or other basis, as otherwise agreed in writing.
- Participating Company
A Participating Company is an entity that provides goods and services directly to customers or in combination with other goods and services provided by BMS or other participants in the BMS Adventure Network. A Participating Company will deliver goods and services to customers under the brands of Participating Company. Participating Company will, where practical, indicate on its website and in its marketing materials that Participant is a member of the BMS Adventure Network. BMS shall have the right to advertise and promote Participating Company as a member of the BMS Adventure Network. Participating Company will be engaged by BMS from time to time as needed for customers. Participating Company sets all prices for goods and services offered to customers. BMS is responsible for collecting amounts due from customers. BMS will compensate Participating Company on an hourly, fixed fee, commission, or other basis, as otherwise agreed in writing.
- Equipment Wholesale Supplier
An Equipment Wholesale Supplier is an entity that supplies equipment and related services to BMS on a wholesale basis. Equipment Wholesale Supplier appoints BMS as a distributor for the equipment. Except as otherwise agreed in writing, BMS will sell the equipment to customers under the brands of Equipment Wholesale Supplier or its licensors. Equipment Wholesale Supplier will, where practical, indicate on its website and in its marketing materials that Participant is a member of the BMS Adventure Network. BMS shall have the right to advertise and promote that BMS is a distributor of Equipment Wholesale Supplier and that Equipment Wholesale Supplier is a member of the BMS Adventure Network. BMS will order equipment from time to time as needed for customer orders. BMS sets all prices for Equipment offered to customers. BMS is responsible for collecting amounts due from customers. Wholesale pricing as between BMS and Equipment Wholesale Supplier shall be the then prevailing price of the equipment or as otherwise agreed in writing.
- Equipment Referral Partner
An Equipment Referral Partner is an entity that supplies equipment directly to customers based on a referral of such customer to Equipment Referral Partner by BMS. Equipment Referral Partner appoints BMS as a referral partner for the Equipment. Equipment Referral Partner will sell the Equipment to customers under the brands of Equipment Referral Partner or its licensors. BMS shall have the right to advertise and promote that BMS is a referral partner of Equipment Referral Partner and that Equipment Referral Partner is a member of the BMS Adventure Network. BMS will refer customers to Equipment Referral Partner from time to time in its reasonable discretion. Equipment Referral Partner sets all prices for Equipment offered to customers. Equipment Referral Partner is responsible for collecting amounts due from customers. Equipment Referral Partner will compensate BMS on a fixed fee, commission, or other basis as agreed in writing between BMS and Equipment Referral Partner.
- Advertiser
An Advertiser is an entity that desires to advertise on the BMS web site in other BMS marketing materials or that desires to sponsor a BMS event. An Advertiser pays BMS the advertising rates mutually agreed to in writing by Advertiser and BMS.
- Web Site Link Partner
A Web Site Link Partner is an entity that desires to include a link to their web site on the BMS web site. Web Site Link Partner agrees to include a reciprocal link on the web site of Web Site Link Partner. No fees are owed by either party with respect to the linking arrangements between BMS and the Web Site Link Partner.
